REPRESENTATIVE MATTERS

  • Presently working as part of the three-person Court Appointed team advising the Receiver in Liquidation for the J. Ezra Merkin funds. Also working as part of the escrow agency team to distribute over $400 million. The funds have a total estimated value of $1.2 billion. As part of this Appointment, we were required to work with J. Ezra Merkin and his staff to take over the operations and management of all related entities and bank accounts, including operational back office functions.
  • Presently representing the chairman of the board of a failed New York bank regarding all criminal and regulatory matters.
  • Presently acting as outside general counsel advising a global not for profit regarding all operational risk issues.
  • Presently acting as outside risk counsel in the United States for a global law firm advising on cross border conflict issues and general firm liability matters.
  • Advised the management committee of a large, global hedge fund regarding operational and fraud related risk in the wake of the Madoff and Dreier Scandals. Conducted an in depth review of company operations and made risk management recommendations for its targeted growth trajectory.
  • Worked as part of a two-person independent monitor team at the request of the Department of Justice to oversee the independence of an investigation, in twenty-three countries, into a large global financial institution accused of significant OFAC violations.
  • Retained by a global media company to analyze existing compliance policies and procedures across all business lines to make recommendations for change in anticipation of the merger closing with a United States based cable company. The matter involves a detailed analysis of both division and functional policies for the new company and also requires collaboration with the highest levels of both division and executive management. The matter involves weekly working group meetings to plan the launch of the new policies, making strategic recommendations regarding the redrafting of existing policies for both companies and will result in a new set of policies for “day 1” post merger close.
  • Analyzed and drafted policies and implementing procedures relating to bank wide anti-money laundering compliance. Matter was the result of regulatory and government scrutiny in the wake of a global money laundering scandal. Collaborated with and interviewed all levels of management and staff to ensure no gaps existed in the design and implementation of procedures.
  • Advised the management of a charity facing a money-laundering allegation by the United States Attorney’s Office, in connection with a political corruption scandal in New Jersey.
  • Worked with the management of several small financial institutions regarding compliance policies and procedures facing issues from significant crises to traditional bank regulatory matters.
  • Worked with the management of an educational testing service, as outside investigative counsel, to advise on its compliance under the No Child Left Behind Act under federal and state law.
